Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and Marcus Rehbock ("we", "us", "our"), the operator of the Budgy AI mobile application and website (together, the "Service"). By downloading or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Apple's standard Licensed Application End User License Agreement (the "Apple EULA") also applies to your use of the app. Where these Terms add to the Apple EULA, these Terms govern; where they conflict, the term more protective of you applies. Apple is not a party to these Terms and is not responsible for the app or its content, but Apple and its subsidiaries are third-party beneficiaries entitled to enforce these Terms against you.
1. The service
Budgy AI generates weekly meal plans and shopping lists tailored to your household and grocery budget. Recipes, ingredient lists, nutritional characteristics, and prices are AI-generated estimates provided for planning convenience only. We grant you a personal, non-transferable, non-exclusive, revocable licence to use the app on Apple-branded devices that you own or control, as permitted by the Apple EULA and these Terms.
2. Eligibility
Budgy AI's content is suitable for general audiences (rated 4+ on the App Store). To agree to these Terms and to make purchases, however, you must be able to form a legally binding contract — generally the age of majority where you live. If you are under that age, you may use the app only with the involvement and consent of a parent or guardian who agrees to these Terms on your behalf and is responsible for any purchases made through the associated Apple ID. By using the Service you confirm that you meet these requirements.
3. Subscriptions and purchases ("Budgy Pro")
- Budgy Pro is offered as auto-renewing subscriptions (for example, monthly and yearly) and as a one-time lifetime purchase. Current prices, billing periods, and any introductory or free-trial offers are shown in the app before you confirm a purchase.
- Payment is charged to your Apple ID account at confirmation of purchase. Auto-renewing subscriptions renew automatically at the then-current price unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- If a free trial or introductory offer is provided, any unused portion is forfeited when you purchase a subscription, where applicable. Unless you cancel at least 24 hours before the trial ends, the trial automatically converts to a paid subscription at the disclosed price.
- Manage or cancel anytime in your device Settings → your name → Subscriptions, or via "Manage subscription" inside the app. Cancelling stops future renewals; you keep access until the end of the period you have already paid for.
- Purchases and refunds are processed by Apple under Apple's policies, not by us. To request a refund, visit reportaproblem.apple.com. Nothing in these Terms limits any non-excludable refund or remedy you may have under applicable consumer law.
4. Allergies and dietary needs — read this
You can list allergens during onboarding and we exclude them from generated plans, validating this in software. However, recipes and ingredient information are AI-generated and may contain errors or omissions. Always check product labels and ingredient lists yourself before purchasing or consuming any food. Do not rely on the app for severe, life-threatening, or medically managed allergies or dietary conditions. Budgy AI does not provide medical, dietetic, or nutritional advice and is not a substitute for advice from a qualified professional. If you have a health condition, consult a professional before changing your diet.
5. Prices are estimates
Ingredient and total prices are AI estimates of typical supermarket prices in your selected currency and store, and will differ from actual shelf prices. Budgeting outcomes are not guaranteed. Supermarket and retailer names appear solely to identify where you shop; Budgy AI is not affiliated with, sponsored by, or endorsed by any retailer.
6. Acceptable use
You agree not to: reverse-engineer, decompile, or attempt to extract the source code of the app except as permitted by law; abuse, overload, probe, or attempt to disrupt the Service or its infrastructure; use the Service for any unlawful purpose; or resell, redistribute, or commercially exploit generated content as a competing product or service. We may suspend or restrict access that we reasonably believe harms the Service, other users, or us.
7. Intellectual property
The Service, including its name, branding, design, and software, is owned by us or our licensors and is protected by intellectual property laws. Meal plans and shopping lists generated for you are yours to use for personal, non-commercial purposes. These Terms grant you no rights in our trademarks or branding.
8. Feedback
If you send us suggestions, ideas, or feedback about the Service, you grant us a perpetual, worldwide, royalty-free licence to use them without restriction or obligation to you. We are not required to keep feedback confidential.
9. Availability and changes
We may update, change, suspend, or discontinue features as the Service evolves. We aim for high availability but the Service is provided without uptime guarantees. We may revise these Terms from time to time; material changes will be reflected on this page with a new effective date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
10. Termination
You may stop using the app at any time by deleting it. We may suspend or terminate your access if you materially breach these Terms or use the Service in a way that harms it or others. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — survive.
11. Disclaimers and limitation of liability
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose and accuracy of AI-generated content. To the maximum extent permitted by law, our total aggregate liability for any claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or USD $50, and we are not liable for indirect, incidental, special, or consequential loss. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, warranty, or right you have under the Australian Consumer Law or other applicable consumer protection laws that cannot lawfully be excluded. Where such a guarantee applies and the relevant goods or services are not of a kind ordinarily acquired for personal, domestic, or household use, our liability is limited, at our option, to resupplying the service or paying the cost of resupply.
12. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Budgy AI and its operator from claims, damages, or expenses arising out of your misuse of the Service or your violation of these Terms.
13. Governing law
These Terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of its courts. This does not affect mandatory consumer protections or rights available to you under the laws of your place of residence.
14. General
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them to a successor in connection with a merger, acquisition, or sale of assets. These Terms, together with the Apple EULA and our Privacy Policy, are the entire agreement between you and us regarding the Service.
